Standard of care is not a standard of perfection. It does not require flawless execution or the best possible outcome. Rather, it asks whether the contractor performed as a reasonably competent contractor would have performed given the same project conditions, contract requirements, and available information at the time.
Standard of practice generally refers to whether a contractor followed accepted procedures, such as proper sequencing, code compliance, and manufacturer installation requirements. Standard of care is a broader measure of whether a contractor's overall conduct was what a reasonably competent contractor would have done in the same circumstances. A contractor can follow standard procedures and still fall short of the standard of care, or deviate from a procedure without breaching it.
